Making a mistake on your return is more common than it seems. A withholding statement that arrived late, a dependent you forgot, an informative return you did not see. That is what the amended return (planilla enmendada) is for: a new version of the return for a year you already filed, which replaces the incorrect information. This guide explains when to file one, how to file it and which deadlines apply, based on the 2025 instruction booklet from the Departamento de Hacienda (Puerto Rico's Treasury Department, "Hacienda") and the Código de Rentas Internas de Puerto Rico de 2011 (Internal Revenue Code of Puerto Rico).
When you should amend
Hacienda's instruction booklet says you should amend your return if:
- you left out income, for example, a second job, interest or an informative return that arrived later;
- you did not claim a deduction or credit you were entitled to, such as the Crédito por Trabajo (Puerto Rico's earned income credit) or mortgage interest; or
- you claimed a deduction or credit you were not entitled to.
It is also common to amend when your personal status for that year changes because of a correction, when you receive a corrected statement from your employer or when you realize you should have used a different computation method (for example, the optional computation for married couples).
When you do not need to. If Hacienda already sent you a notice with an adjustment to your return, read carefully what it asks of you. Often the right response is to answer that notice within the stated deadline, not to file an amendment on your own. See Hacienda notices.
Deadline to file the amended return
According to the 2025 booklet, the amended return must be filed within four years after the date the original return was filed.
José filed his 2025 return on April 2, 2026. In September 2026, he receives a 480.6B informative return that he had not included. He can amend his return at any time until April 2, 2030. But because the amendment will increase his tax, it is in his interest to do it right away to reduce interest and surcharges.
How to file it
Like the original return, the amended return is filed electronically. In general terms:
- Gather the correct information: the form you were missing, the corrected statement or the evidence for the deduction.
- Log in to SURI (Hacienda's online system), or use certified software or your tax specialist, and find the return for the year you are correcting in the Individuo – Contribución sobre Ingresos (individual income tax) account.
- Select the Amended Return option. The booklet asks you to fill in the matching oval in the return's heading.
- Complete the return with all the correct figures, not just the ones that change. The amended return replaces the original.
- Include an explanation. Hacienda requires a statement explaining the reason you are amending.
- Submit any supporting evidence that applies, sign electronically and keep the confirmation number.
If a specialist prepares your amendment, the same rules apply as for the original return: they must sign it, include their registration number and have your written authorization to file it and sign it digitally.
Before amending, check in SURI that your original return already shows as filed. If the original is still being processed, ask Hacienda Responde (Hacienda's help line) at (787) 622-0123 when the best time is to submit the amendment.
If the amendment results in more tax
If the correction increases what you owe, pay the difference as soon as possible. The additional tax is considered due from the return's original due date, so it accrues 10% annual interest and the surcharges set by the Code (5% if the delay is more than 30 days but not more than 60, and 10% if it is more than 60). Correcting on your own, before Hacienda catches it, is generally better than waiting for a deficiency notice.
If you cannot pay everything, you can request a payment plan with Hacienda. Estimate the cost with the interest and surcharge calculator.
If the amendment results in a refund
If the correction works in your favor, the amended return is your refund claim. Under Section 6021.02 of the Code, you must claim within four years from the date you filed the return or three years from the date you paid the tax, whichever ends later. The amount you can recover is limited to the tax paid in the corresponding period. More details in Hacienda refunds.
Hacienda's deadlines to review you
The amended return also affects how long Hacienda has to assess (determine) additional tax. Under Section 6010.05 of the Code:
| Situation | Hacienda's deadline to assess |
|---|---|
| General rule | 4 years from the date you filed the return |
| You left out of gross income more than 25% of what you reported | 6 years from the date you filed |
| You amend within the 183 days before the assessment deadline ends | Hacienda has 2 years from the date it receives the amended return to assess additional tax |
There are exceptions in Section 6010.06 of the Code. If no return was filed, or if it was filed falsely or fraudulently with intent to evade, Hacienda can assess at any time. The deadline can also be extended by written agreement between Hacienda and the taxpayer. If you are in a situation like this, get advice. Also read tax debts and the statute of limitations.
Ana filed her 2022 return on April 14, 2023. Hacienda's general deadline to assess that year ends on April 14, 2027. If Ana amends in January 2027, within the 183 days before that deadline, Hacienda would have two years from the date it receives the amended return to assess additional tax.
Common mistakes when amending
- Filing a second original return instead of marking it as amended. This creates confusion and can delay everything.
- Including only the lines that change. The amended return must be complete.
- Not explaining the reason. Without the statement, Hacienda may ask you for more information.
- Forgetting the effect on other benefits. A change in income can affect your Crédito por Trabajo or your eligibility for other programs that use information from the return.
- Forgetting the federal return. If the same error affects a return with the IRS (for example, Form 1040-SS for self-employment income), the federal correction is a separate process. See Social Security for self-employed workers.
Frequently asked questions
Do I have to pay anything to file an amended return?
Filing it in SURI is free. What you might pay is the additional tax that results, with its interest and surcharges, or a specialist's fees if you hire one.
Can I amend a return from five years ago?
According to Hacienda's booklet, the amended return is filed within four years from the date you filed the original. After that deadline, you generally can no longer claim a refund for that year. You could still have to pay if Hacienda can still assess, for example, in cases of substantial omission of income.
My employer sent me a corrected withholding statement after I filed. What should I do?
Compare the corrected statement with what you put on your return. If your wages or the tax withheld change, you must amend. See withholding and forms.
Does an amended return increase the chances of an audit?
Hacienda does not publish its audit selection criteria. What we do know is that it can ask you for evidence of the changes, just as for any item on the return. What matters is that the amendment is correct, explained and backed by your documents.
